Terms & Conditions: Rob Shinn Photography

1. Introduction

These Terms and Conditions ("Terms") govern all photography, full-service production, and editing services provided by Rob Shinn Photography ("we," "us," or "our") to clients ("you" or "the client"). By booking our services, you agree to these Terms.

2. Booking & Payment

A 50% deposit of the total estimate is required to secure a booking. Deposits are non-refundable unless otherwise stated in writing.

For non-account clients, the remaining balance must be paid in full before the shoot.

For account clients (clients with pre-approved invoicing terms), an invoice will be issued for the remaining balance with a 30-day payment term from the date of the shoot.

Additional costs, such as travel expenses, accommodation, and subcontractor fees, will be outlined in the contract and must be covered by the client.

3. Cancellations & Postponements

3a Postponements:

• Postponements within 10 working days of the scheduled shoot date will incur a 50% postponement fee, covering lost time and commitments.

• In the case of postponements, the client will be charged 50% of any booked and confirmed subcontractor fees.

• Confirmed studio bookings cannot be refunded, and full payment will be due in the case of postponement.

• Rescheduling is subject to availability and may require a new agreement.

• If postponement is due to force majeure (e.g., extreme weather, illness, or unavoidable circumstances), rescheduling will be considered without additional charges where possible.

3b Cancellations:

• Cancellations within 10 working days of the scheduled shoot date will result in a charge of 100% of the total booking fee.

• For cancellations, the client will be charged 100% of booked and confirmed subcontractor fees.

• Confirmed studio bookings cannot be refunded, and full payment will be due in the case of cancellation.

• If cancellation is due to force majeure, we will work with the client to reschedule where possible, but fees may still apply for non-recoverable expenses.

4. Production & Editing Services

• Full-service production, including pre-production planning, crew hiring, location scouting, and post-production, will be agreed upon in advance.

• Editing services include colour grading, retouching, background alterations, and other enhancements as outlined in the agreement.

• Revisions beyond the agreed scope will be subject to additional charges.

• The client must provide clear and detailed editing requirements before work begins. Any changes after delivery may incur additional costs.

5. Image & Video Delivery & Usage

• Final images and videos will be delivered within the agreed timeframe.

• Copyright remains with Rob Shinn Photography unless otherwise agreed in writing.

• Clients are granted a non-exclusive licence for the agreed-upon usage only. Additional usage, including resale or third-party distribution, requires further negotiation and payment.

• The licence does not include raw files unless expressly agreed upon in writing.

6. Liability & Force Majeure

• While we take every precaution to deliver high-quality work, we are not liable for unforeseen circumstances beyond our control (e.g., extreme weather, illness, or equipment failure).

• In the event of force majeure, we will work with the client to reschedule where possible.

• We are not responsible for any indirect damages, loss of profits, or consequential losses resulting from delays or delivery issues.

7. Client Responsibilities

• The client is responsible for obtaining all necessary permissions, including location access and subject consent, before the shoot.

• Any delays caused by the client may result in additional charges.

• For editing services, the client must provide all necessary assets in the required format and within the agreed timeframe.

8. Agreement

By proceeding with a booking, you confirm that you have read and agree to these Terms.
